Website Content Use Agreement

These terms, known as the "Website Content Use Agreement," outline the rules for using this website. If you do not agree with the terms, please refrain from using the Platform. By accessing the Platform, you accept these terms. Placements Bay reserves the right to modify these terms from time to time, and we advise regularly checking this page for any changes. The terms "You" and "User" apply to all persons or entities that access the Platform.

You may access a single copy of the Platform's content, including text, images, and other materials, for personal and non-commercial purposes only. The content is protected under U.S. and international copyright laws, and unauthorized usage could result in copyright infringement.

Terms of Service Agreement

By accessing our Services, you acknowledge that we do not verify the authenticity, accuracy, completeness, truthfulness, or legality of third-party content. You also recognize that we do not govern the integrity, behaviour, or actions of Job Seekers or Clients.

Minimum Age Requirement

To use our Services, you must be at least 18 years old or the legal age of majority in your area, allowing you to legally enter into a binding agreement with Placements Bay. If you are under 18 but legally permitted to work in your jurisdiction, a parent or guardian must review and consent to this Agreement.

Consent for Email Communications

By providing your email address to Placements Bay, you agree to receive email communications from us, including updates about our Service and other non-commercial notifications, such as legal notices, in lieu of postal mail. Additionally, we may use your email to share information about Service updates and special offers, in accordance with applicable laws in your area.

User Conduct Guidelines

As a user, you must refrain from the following actions:

  • Unauthorized copying, sharing, or revealing any part of the Services.
  • Using automated tools to send excessive requests that overwhelm our servers.
  • Sending spam, unsolicited messages, or attempting to compromise the security or integrity of our systems.
  • Engaging in activities that place undue burden on our infrastructure or uploading harmful files or software via the Services.
  • Using the Services for commercial promotion, impersonation, or misrepresenting your affiliation.
  • Disrupting the normal operation of the Services or accessing them through unauthorized channels.
  • Bypassing our access control measures, reverse-engineering the Services, or framing/linking to our content.
  • Providing false or misleading information or posting offensive material.

Placements Bay retains the right to determine what is considered offensive content.

User Content Guidelines

The following types of User Content are strictly forbidden. This list is illustrative and not exhaustive. You agree not to share or provide User Content that:

  • Could potentially lead to injury to any individual or damage to property.
  • Provides advice or details about unlawful activities.
  • Involves the distribution of unsolicited communications, including but not limited to phishing schemes or scams.
  • Contains links to illegal or offensive material or seeks Personal Data from individuals under 18.
  • Includes any information or content deemed illegal, harmful, abusive, racially or ethnically offensive, defamatory, infringing on personal privacy or publicity rights, harassing, demeaning (publicly or privately), libelous, threatening, vulgar, or otherwise objectionable.
  • Involves illegal information or content, including but not limited to the disclosure of insider information under securities law or another entity's trade secrets.
  • Contains any information or content you lack the legal authority to distribute under any law, contractual obligation, or fiduciary duty.
  • Presents information or content that is false, misleading, or deceptively inaccurate.
  • Violates the Intellectual Property Rights or privacy rights of any third party. For this Agreement, "Intellectual Property Rights" encompasses patent rights, copyright rights, mask work rights, moral rights, publicity rights, trademark rights, trade dress, service mark rights, goodwill, trade secret rights, and any other intellectual property rights.

If you are a Client submitting Job Advertisements, you also agree that such content shall not include any personally identifiable information.

User Content Disclaimer and Liability Waiver

Placements Bay has no obligation to verify the truthfulness, lawfulness, or quality of the content provided by users. Users should be aware that some content may be inaccurate, misleading, illegal, offensive, or otherwise inappropriate, and it is the user's responsibility to evaluate the quality and legality of the content they engage with. Your decision to use User Content is made at your own risk.

While Placements Bay reserves the right, at its sole discretion, to remove or restrict User Content or accounts that violate these Terms, related agreements, applicable laws, or pose a potential risk to Placements Bay, it is not obligated to do so.

User Interaction Risk Acknowledgment and Acceptance

By agreeing to these terms, you acknowledge that Placements Bay does not verify the identity or trustworthiness of Users. Placements Bay is under no obligation to confirm the authenticity of any User on the platform. Therefore, it is your responsibility to conduct your own evaluation before engaging in any communications or interactions, whether with job seekers, employers, staffing agencies, or recruitment firms.

You accept all risks associated with engaging with any User encountered on the platform. In case of any conflicts or issues with any User, you agree to resolve them directly with that User.

By accepting this agreement, you release Placements Bay, its affiliates, and their respective employees, directors, and agents from all claims, liabilities, and damages of any nature, including direct, indirect, actual, or consequential damages, whether anticipated or not, to the fullest extent allowed by law.

Disclosure of User Information and Content

Placements Bay reserves the right to share User Content and related information about the individual who submitted it with third parties. This may be necessary for the purpose of providing our Services, enforcing any agreements made with you, complying with legal requirements, or responding to inquiries from governmental agencies, law enforcement, court orders, subpoenas, or other legal processes.

Moreover, in order to protect the interests of Placements Bay, we may determine that sharing such information is warranted. By agreeing to these terms, you consent to our authority to disclose your identity to any third party who alleges that any User Content you posted, uploaded, or submitted is fraudulent, false, misleading, illegal, infringes on intellectual property or ownership rights, or violates privacy rights.

Restrictions on Use and Confidentiality

You agree not to utilize the Website for unauthorized commercial activities, resale, or distribution. Any business, technical, or financial data obtained from us is considered confidential and should not be disclosed except as legally permitted.

Ownership Rights, Copyright, and Suggestions

All ownership rights to the Service, excluding user content, are held by Placements Bay and its licensors. The Service is safeguarded by copyright, trademark, and other intellectual property regulations. Any feedback or recommendations you provide are voluntary, and we may use them without any obligation to provide compensation.

Liability and Termination Policy

The total liability of Placements Bay, regardless of the basis for the claim (whether in contract, tort, breach of warranty, etc.), shall not exceed $100. Placements Bay retains the right to pursue all legal remedies available, which may include removing your posts and terminating your registration or access to our services if any of these terms are violated or if the information you provide cannot be verified.

Placements Bay does not guarantee the legality of accessing the Website Content from outside the United States. By choosing to proceed, you agree to comply with your local laws. Continued use of the Service after such updates signifies your acceptance of the revised terms.

User Responsibilities and Acceptable Use

Users must engage with the Website in accordance with applicable laws and in a way that honours the rights of others. This includes refraining from actions that may infringe on copyrights, trademarks, or personal rights, and avoiding content that is defamatory, obscene, threatening, abusive, or hateful.

Users are prohibited from compromising the Website’s security, which includes unauthorized access and interference with its services. Breaching these guidelines may lead to legal consequences, and we may work with law enforcement to address violations. The Website is designed exclusively for job seekers and employers looking to recruit.
